The Aberdeen proving ground located in Maryland, is a U.S military facilities where
chemical weapons among other things were developed and manufactured. The case involved
three senior civilian managers. They were all chemical engineers in charge in the chemical
weapons which were being developed. In the year 1989 the three managers were charged with
criminal felony, tried and convicted of illegal storage, handling and disposal of hazardous wastes
in violation of the resource conservation and recovery act (RCRA). These violations occurred
between the years of 1983 and1986 (Tomlinson 1990).
The U.S army has been using the Aberdeen proving grounds to develop, test and store
chemical weapons since the Second World War. During periodic inspections between 1983 and
1986 revealed numerous problem with the facility which was recognized as the pilot plant. Some
of the issues discovered were; flammable substances were left in the open, chemicals that
became lethal if mixed were found stored in the same room. Chemicals were laying everywhere
misplaced, unlabeled and poorly handled. Spilled substances were not properly cleaned after and
the storage facility was not properly maintained hence it was concluded a hazardous place.
The three engineers were consulted and maintained that they did not believe that the
practices which were undertaken were illegal and that their job description did not specify their
responsibility for certain environmental rules. They further stated that they practiced good
engineering sense and they had never had an incident that compromised them and they were
caring on work as it has always been in the pilot plant.
Following the previous indictment the federal government took the case to court, each
defendant was charged with four counts of illegal handling, storage and disposal of waste.
Although they did not directly perform these illegal acts, they were the overall managers and
they did not take keen measurements according to the RCRA. They were sentenced to three
years’ probation and 1000 hours of community service. The decision was based on the high
standing of the defendants in the surrounding community and the fact that they had incurred
various court costs. The U.S army however could not assist in their legal defense since this was a
criminal indictment.
The violation of the code of professional ethics
The three engineers were knowledgeable of the effects the chemicals used would impact
on the environment and the people. However they were seemingly unconcerned about the
hazardous disposal and storage of these chemicals. All hazardous chemicals have precise
instructions on how to handle, store and dispose, but they still maintained that they did not have
any knowledge hence this marked their sheer ignorance.
According to (nersturuk, 1996) a professional engineer some key elements need two be
examined, this is done from two perspectives: the implicit social contract between engineers and
society and the guidance of code of ethics of professional societies. Therefore these three
engineers did not uphold their responsibilities to the public as engineers, since they should
always be aware of their obligation to the society.
In additional to societal responsibilities the Aberdeen three had responsibilities to their
subordinates, which was reportedly overlooked. The employees were working in deplorable
conditions, chemicals dripping from leaking pipes above. In addition to the employees did not
have prior training, and they were ordered to dispose and handle chemicals which they had little
or no knowledge about.
The three engineers possessed knowledge of the dangers of the chemicals they handled,
to their subordinates, to the environment and the surrounding community. However they chose to
disregard this. They were utterly misguided by their loyalty to the military mission and choose to
neglect their responsibility to the society as qualified engineers.
