Running head: HIS, HERS, OR ‘NOT APPLICABLE’?
HIS, HERS, OR ‘NOT APPLICABLE’? – WHY SHOULD IT MATTER?
I. Transgenders along with other non-gender conforming members of society are discriminated
more than cisgender individuals that result to verbal and physical assault, even leading up to
death.
A. There is a growing number of transgenders, especially women of color who have lost
their lives due to hate violence.
1. The National Coalition of Anti-Violence Programs (NCAVP) reported a
multi-year trend of ‘death by hate violence’ committed against transgender
women (Schmider, 2016). As of 2016, there have been 27 transgender deaths
reported, five of which were committed in the last quarter.
B. Even people in positions of support such as police officers and healthcare professionals
have been reported to commit sexual assault against transgenders.
2. While sexual assault can be committed by anyone, there is a percentage of
incidents perpetrated by people in these positions that have been reported
(OVC.gov)
II. Having access to a safe public bathroom or similar facility is a basic right; being denied
access is a violation of that right like denying an individual food and water for sustenance.
A. While there are mixed interpretations on whether transgenders can use the bathroom
that is consistent with their gender identity, the law is clear that everyone has the right to
use the bathroom whenever they need to. Several states have serious discussions on
whether or not to support the bill that would ban any person from going into a bathroom

unless it matches their biological sex.

A. Concerns raised by those who support the bill voice their concerns about privacy and
physical safety of women and children in the restrooms.
IV. Concerns raised by those who support the bill voice their concerns about privacy and
physical safety of women and children in the restrooms, however, these concerns are still to be
proved.
A. The opposition argues that by opening bathroom access to the opposite sex places
women and children in greater risk of being sexually assaulted because predators can
claim that they are transgenders to gain access (Intelligence Report, 2016). However,
there has been no facts that can back this claim.

identifying with the opposite sex is a mental disorder.

The debate on the transgender rights has led to contradiction regarding laws that govern it
regarding accessing public bathrooms. The concern for transgender people on choosing
bathrooms has based on the gender they identify with has been quite a handful issue and may
lead to a civil rights issue (Times, 2017). For that reason, many states have taken the initiative to
level the issue by passing the law concerning all-gender restrooms due to a concerning pattern at
the educational institutions (Times, 2017). In the year 2015, President Obama mentioned the
transgender state while addressing the State of the Union (Times, 2017). He advocated for
expression regarding speech; he shunned women being persecuted due to their religious beliefs
and the LGBT community.
Most public schools are rejecting the bathrooms by requesting the transgender students to
use their showering and private areas thus leading to discrimination claims. For instance, in
Chicago, there is a high assertion of the transgender students as the educational institutions have
hesitated to the bathroom and locker room (Times, 2017). There have been policies that have
been fashioned that require the transgender students to use changing and showing facilities that
are private (Times, 2017). However, some states are completely not considering the matter. For
instance, in Wisconsin, there has been a bill proposal on chaining the transgender students from
using the restrooms according to the gender that they identify with. This is discriminatory and a
suppression of rights as well as gender identity.

2017, from http://edition.cnn.com/2017/08/01/opinions/gender-neutral-drivers-license-opiniondavis/index.html
In our current generation, people are still claiming that they have evolved and are
becoming more open-minded, the LGBT community still faces discrimination on many levels.
Contrary to this statement, there have been some positive turns in our society that might just
show a shred of hope. There have been new policies and languages that help in addressing the
gender identities while not making a big deal out of it. Language is a focal point of
communication thus people shouldn’t make a big deal, and they should stand above the
assumption that everyone should be treated equally despite their gender.
The manner in which we perceive the different people in society is evidence to how we
are evolving as intelligent people. In the state of Washington, the system of government offers a
non-binary option on the driver’s license which allows drivers to select ‘X’ for unspecified. In
California, the legislation proposed for the addition of the unspecified gender option to birth
certificates as well.
Humans are evolving species thus taking the step to acknowledge and be content with the
changes that come with it show our development and maturity. In a state of chaos, we should
build a temple of love; this is directed to the idea of addressing each other in the workplace all
the while not focusing on the gender discrimination. This should be done by the adoption of a
company norm based on a wide gender-neutral pronoun.

Boles, Jacqueline, and Tatro, Charlotte. (2013). Androgyny (subsection Gender-identity
formation), in Men in Transition: Theory and Therapy.
Our future is filled with many diverse events that support our evolution. Throughout
history, gender diversity has existed all over the world thus forming the most fundamental
aspects of a deep influence over the individual. According to (Boles, Jacqueline & Tatro,
Charlotte, 2013), the policies made require that no individual shall be stopped, arrested or
questioned for using restrooms including in bus stations and any other public place. This
supports the base of belief where the individual’s gender expression doesn’t define or match the
gender designation of the single-sex restroom.
The bathroom bill has led to the assumption that transgender people conform to their
gender identity thus threatening their safety. There has been criticism cases where there have
been attacks on transgender people. This brings out the attention on the cases of transgender
people being physical, verbally and sexually attacked in the public facilities (Boles, Jacqueline &
Tatro, Charlotte, 2013).

Not all leaders are the same. According to (Times, 2017), our current leader reversed the
rules on the protection of the transgender kids which gave them the opportunity to use bathrooms
depending on the gender they identify with. His decision overruled his education security. For
that reason, this led the Supreme Court to shift its decision.

Not everything will go accordingly, but at least they should be fair. The issue on gender
identity has always been within our global society. We should protect the rights of every
individual, especially our future leaders who are under much pressure in schools. They face
continuous discrimination ignoring that fact that the matter has been part of our tradition by
differentiating and respecting the sex’s difference.
In Chicago, there was a case on a transgender who identifies as a girl changing in the
girl’s bathroom. This matter has been appointed of confrontation. It later sprung a strong fight on
how the transgender pupils should be embraced or accommodated (Times, 2017).
Kennedy, m. (2015). Transgender students and bathrooms. American School & University,
87(8), 18. Discusses the advancement of support from colleges and universities to provision
gender-neutral bathrooms that will accommodate transgender students.
According to Kennedy, a society and its norms make it difficult to understand and accept
that people are different and they have the same rights as any other ordinary person. I must agree
that some few elements are slowly conforming to the matter. This has led to the topic being a
point of discussion in our daily lives as we are learning how to live with it (Kennedy, 2015). This
can be seen through film adaptations of films and TV shows such as The Danish Girl portrayed
by Eddie Redmayne who plays a man struggling with gender identity in the mid-1920s and other
shows as well. This shows how this has always been an issue from the very beginning
With a growing population, more people are coming out and claiming their position in
society. The support comes shown by the driving license and birth certificate adaptations which
will ensure that people use public restrooms that match their sex at birth. This has faced wide
criticism with people varying with their opinions. Most people relate to public safety and
scrutiny.
THE ISSUE ON GENDER BATHROOM
6
There have been claims that there is a sexual advantage with public places such as
bathrooms, this leads to the claims and laws that cover the transgender people by insinuating that
they attack children and women in the bathrooms. This has been received with antidiscrimination protections that cover gender identity as well as showing its long-lived existence
for years. For that reason, some states have placed antidiscrimination laws that allow transgender
people to use public facilities that align with their gender identity.
