Thread One Business Owners may be held liable for civil and
criminal injury and accountable for intentional and unintentional
injury. Intentional would be a physically bodily harm. Unintentional
would be a vehicle or motor accidents that may not have been
intended for but to accounted for.Allegation sold or manufactured
by the business that can cause injury would be a for instance a
blender company sold a faulty blender that erupts during process
from overhead or faulty mechanical. Which would be a good
cause of judgment against the defendant would include. Ethical
consideration when a manufacturer sells or market their products
would be to insure the product is used correctly along with safety
hazards and product protocol and use at extreme caution
according to safety manual.

THREAD 1
Question 1
1. You have just developed a machine that will turn household
garbage into usable fuel. You want to control the use of your
invention. You are also concerned about the image of your
invention. Explain all of the ways you can control the market and
use of your invention. Explain what you can do to protect the
image of your invention. Make sure you cite to the “authority”
(statutes etc.) that you used to come to your conclusion
If one just developed a machine that turned household garbage
into fuel, and wants to control the use as well as the image of
there product, One would want to apply for a patent. When a
great idea is converted into a tangible investment large or small,
it is a good idea to patient your invention. The patent is issued by
the United States Patent and Trademark office. What they do is
give the owner of the invention the right to exclude others from
making, selling, offering the sales of there product here or
overseas. The patent is there protection from this . But because a
patent can be a lengthy process, its best to file for a provisional
patent. There is no legal rights with this but it does show the date
you filled and guarantees you a file date with the USPTO.
Because not every application is approved they can not stop
actually stop someone from selling or copying your product until
the patent is granted. But you can file for provisional rights, which
will help in seeking realities if product was made after your
application went public. So its best not to try to sell your product or
market it until it is patent..Its also a good idea to incorporate your
business and trade mark logos

Thread One:
After developing a product like a machine that changes household
garbage into useable biodegradable fuel having the proper
patents and copyrights are very important. In creating such a
product many larger companies would feel threatened by seeing
how there business might be negatively effected.Larger
corporations such as waste management and Edison would see
an invention of such a product as a problem to there future
earnings and would take steps to counter act the use of such a
product. In creating and marketing such a product not having the
proper copyright information and patent licencing could lead to
other larger companies making a similar product and marketing it
as the original which happens a lot through out history. Making
sure that the logo and trademark for your product is 100% legally
protected is very important. Also ensuring that the patents on your
product are thorough enough to were any replication of the
product would allow you to pursue legal action.Having the proper
legal protection would make it impossible for any company
regardless of how big to make a different variation of that
invention.

If you have just developed a machine that will turn household
garbage into useable fuel, you’d want to control the use of
your invention in various ways. The most important and the first
you should consider is a patent. A patent allows for your
intellectual property (which would be the machine) to be your
property and not be used by anyone else for a certain amount of
time. As long as the competitor’s item isn’t completely derivative
of yours, they cannot make any money off of it or use it. However
patents often take over a year to be mad legal and official, so in
that meantime you can file a provisional patent which is basically
a soft patent. It allows you to have a filed date of your idea which
allows for your idea to stay your own in the meantime. This
provision is served by the United States Patent and Trademark
Office and could potentially avoid having your idea stolen. If you
happen to move forward with this process, you could also
trademark your name and image like Mcdonalds in order to keep
full control over it.

First and foremost, I would control the market and use of my
invention by acquiring a Utility patent. A utility patent, which is
awarded to machines among other items, gives me the legal right
to be the only one to make the machine, it excludes anyone from
making, using, or selling it without my authorization. The U.S.
Patent and Trademark Office is the agency that issues the patent
for the invention of my machine as well as the license for the right
for others to use or sell my machine. The USPTO
Secondly, I would protect my invention’s name by trademarking
the name or logo. A trademark is also issued by the U.S. Patent
and Trademark Office and protected by the federal law and the
Lanham Act. Unlike a patent a trademark can last forever and
therefore it is important to protect it at time of inception.
Lastly I would try and maintain the invention’s unique formula or
process a Trade secret. The difficult aspect of maintaining it a
trade secret is that although some states have adopted the
Uniform Trade Secrets Act, not all have adopted it and there is no
federal law protecting them.
