According to the case study Jim would face different judgement for the same crime during the
two time periods. This two time periods are the colonial period of America and also the early
twenty first century. The case study that the paper will focus on is about Jim who has a chance to
exist in the two periods. The man is said to have a habit of looking for trouble. Now the concept
is what would happen if he was to face the juvenile justice system for the crime of smashing and
entering into a home with infuriating conditions of assaults someone during this two historic
periods of the Juvenile justice system of America (Parsloe, 2017).
This question covers the history of the system of justice regarding to juvenile courts and
punishment. There are theories that relates to Jim misconduct during both the colonial period
and the twenty first century and h ow he would be judged on the two different time periods. Also
there is the involvement of psychological and sociological theory employed in the Jim’s
behavior. There is different ways to treat Jim employing the psychological and sociological
theory during the two times (Parsloe, 2017).
During the two periods Jim would get a jail, trial and punishment for the crime. The difference
would be that, during the colonial period the person would not be held in jail or a prison like in
the twenty first century. During the colonial period people enjoyed less freedom and rights
compared to twenty first century. If Jim committed the crime during the colonial period,
regardless of the type of crime, whether of theft, assault or murder, he would be jailed
immediately awaiting trial sitting in a cold and probably fifty jail cell. The Jim’s trial would then
be held in a court room before a group of strangers which is totally a different case compared to
now (Bartollas, & Miller, 2014).
In case Jim was caught in the act of committing a crime or if a person decided to turn him in for
one. During the colonial time period the judgement was harsher compared to now, it was harsher

than staying in a detention center or prison or even jail. There were wooden structures referred to
as stocks and the pillory, this two were used to punish offenders. The two structures would be
placed of the criminals and be displayed in public for everyone to see. The stock was used to
hold the criminal’s feet and the stock would hold both the head and hands. The worst part of this
kind of punishment is that, the authorities would then nail the offender’s ears to the frame. The
offender would then receive other punishments like water ducking and whipping which were just
but a common punishments (Bartollas, & Miller, 2014).
For the case of children who committed a crime or were found to be bi-racial, they were forced
into apprenticeship until they attained an age of thirty one. In case the authorities deemed the
crime not severe the offender would pay a fine to replace whipping. When a criminal was unable
to pay the fine, he would be forced to stay in the jail until they had the ability to pay the fine in
full amount. In this period things such as juvenile being placed into a detention center or being
sent into a prison like an adult were not there. In this period children had no special privileges,
they were treated and punished just like the adults (Bartollas, & Miller, 2014).
During the twenty first century people have independence and freedom. The Declaration of
independence although they still have to follow the rules. There is no way we can make a threat
to do a bodily harm to an individual because that act is classified as a misdemeanor or in other
words a felony depending on the type of threat the offender has made in the court of law
(Parsloe, 2017).
A theory would not have the mobility and also would contribute to the rise of shaming in the
colonial period. In twenty first century if Jim committed the same crime, he would be taken to the
court of law. He would then be sent off to an adult court, depending on his age and then be sent to
a trial. This would be obviously be a felony and he would have to serve some specified time in

prison. Also he would be put in a probation. A wide discretion of juvenile judges gives an authority
to a juvenile to be given a warning and then release him. The offender may even be sent to
probation. He may also be placed in a day treatment or residential program. The offender nowadays
may be placed in the care of department of corrections to be corrected. He may also be taken to
the youth authority department or even the youth commission to be interviewed closely. In the
period of twenty first century individuals who committed crimes would be arrested through the
police department, the accused would have to go through a judicial process. The accused then
undergoes an adjudicatory hearing. Then he faces a trial, there is the judicial disposition. In this
case the offender is either taken to a rehabilitation place in a correctional agency or an aftercare
parole. The offender may have a chance to make a commitment whereby he would serve an
imprisonment term. For the case of juveniles, they are sent to a detention which is the same as
being held in jail (Parsloe, 2017).
